Terms of Service
Please read these Terms of Service (“Terms”) before using the Seashell mobile application (the “App”).
By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App
Seashell is operated by SoberSend (registered messaging brand Matthew Stitz), based in Washington, USA. The App lets an account owner invite a family member (a Legend) to answer a question in their own voice. Invited Legends can open a unique HTTPS link without creating an App Store login or password.
2. Eligibility
You must be at least 13 years old to use the App. If you are under 18, use the App only with permission from a parent or guardian.
3. Your account
- Provide accurate information.
- Keep your credentials secure and tell us if you suspect unauthorized access.
- You may request account deletion by emailing sobersend@gmail.com.
- We may suspend accounts that violate these Terms.
4. SMS Terms
Seashell SMS is sent by the registered brand Matthew Stitz for the Seashell product.
SMS is optional. Consent to SMS is not required to use Seashell, create an account, start a Legend, or send a question (email works without texts). People who want texts opt in on the public form at https://seashell.family/sms/ (mobile number plus an unchecked-by-default optional checkbox) or in the App when an owner chooses Text message. That is consent to receive transactional SMS from Seashell, including a family question, a unique HTTPS link to answer in their own voice, and a support contact.
- Message and data rates may apply.
- Message frequency depends on how often the owner sends questions. It is not a marketing campaign.
- Reply STOP to opt out of further SMS. Reply HELP for help, or email sobersend@gmail.com.
- Carriers are not liable for delayed or undelivered messages.
We do not send marketing SMS. Details about how we handle SMS opt-in data are in our Privacy Policy.
5. Subscriptions
Paid features, if offered, are billed through the app store or payment provider shown at checkout. Trial length, price, auto-renewal, and cancellation are described in the App at purchase. You can request cancellation help at sobersend@gmail.com.
6. Acceptable use
You agree not to abuse, disrupt, or reverse-engineer the App; not to harass others; not to upload unlawful content; and not to send messages to numbers without permission.
7. User content
You retain ownership of questions, recordings, and other content you submit. You grant us a license to store and display that content as needed to operate the App for the people you invite.
8. Privacy
Your use of the App is also governed by our Privacy Policy.
9. Disclaimer
The App is provided as is and as available. We do not warrant uninterrupted or error-free operation.
10. Limitation of liability
To the fullest extent permitted by law, SoberSend and Matthew Stitz are not liable for indirect or consequential damages arising from your use of the App. Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the fullest extent permitted by law.
11. Changes
We may update these Terms. The “Last updated” date will change. Continued use after an update means you accept the revised Terms.
